Terms and Conditions
1. Acceptance of Terms:
By booking a tour with Korcula Wine Tours ("Company"), you ("Client" or "Guest") acknowledge and agree to be bound by these Terms & Conditions. These Terms & Conditions constitute a legally binding agreement between you and the Company.
2. Tour Participation and Physical Requirements:

Guests acknowledge that Korcula Wine Tours involve walking, climbing stairs, and traversing uneven surfaces, including but not limited to vineyards, cellars, and cobblestone streets, and dirt roads.

Guests are responsible for assessing their own physical fitness and ability to participate in the tours.

The Company shall not be liable for any injuries sustained by guests due to falls, slips, or other accidents occurring during the tour, regardless of the cause. Guests assume all risks associated with participation.
3. Alcohol Consumption and Intoxication:

Korcula Wine Tours involve the consumption of alcoholic beverages. Guests are expected to consume alcohol responsibly and in moderation.

The Company shall not be liable for any injury, illness, or death resulting from the consumption of alcohol during or after the tour, including but not limited to intoxication, alcohol poisoning, or accidents caused by impairment.

Guests agree to release and hold harmless the Company from any and all claims arising from alcohol consumption.
4. Vehicles and Conduct:

Non-Smoking and Food Policy:

Our vehicles are strictly non-smoking.
-
Client agrees that there will be no smoking in our vehicle(s).

If smoking does occur, Client will be charged a $500.00 fumigation/cleaning fee.

No eating of food is allowed in our vehicles.

At the discretion of the driver, violation of our terms regarding smoking/food may result in immediate termination of the services and forfeiture of all paid deposits and fees for service.

Alcohol Consumption & Passengers Under 18:

In compliance with Croatian Regulations, consumption of alcoholic beverages by passengers less than 18 years of age is prohibited.

The driver reserves the right to check the identification of any passenger at any time during services if underage alcohol consumption is suspected.

Conduct/Damage to Vehicle:

Client and all passengers in Client’s party are expected to conduct themselves in a manner not injurious to themselves, to third parties, or to the hired vehicle. All passengers agree to behave in an orderly and well-behaved manner.

Client is responsible for any damages to the vehicle caused by him/herself or any guests in his/her travel party. In the event of any physical damage to the limousine caused by Client or any passenger, there will be a minimum additional charge of $500.00 for the repair and/or cleaning of the vehicle. This includes anyone getting sick in the vehicle.

Korcula Wine Tours reserves the right to expel any person from the vehicle and/or terminate this contract in the event of a violation of any of these conditions by any passenger. If at any time the service is terminated due to unruly conduct, damages to the vehicle, or abuse of any kind that we deem valid, no refund of money will be made. Korcula Wine Tours reserves the right to refuse service as it deems appropriate.

5. Limitations of Liability:

General Limitation: Korcula Wine Tours shall not be liable for any injury, illness, death, loss, damage, or expense arising from participation in the tours, regardless of the cause, including but not limited to negligence on the part of the Company.

Lost or Damaged Items: Korcula Wine Tours is not responsible for lost or damaged luggage or for any baggage, personal belongings or any items left in the vehicle, winery, farm or establishment during or after use of our services.

Assumption of Risk: Guests acknowledge and assume all risks associated with participating in the tours, including but not limited to risks associated with walking, climbing, uneven surfaces, and alcohol consumption.
6. Cancellation and Modification Policy
Deposit Policy:

All deposits submitted for reservations with Korcula Wine Tours are non-refundable.
Tour Cancellation by Client:
-
Tours are considered non-refundable within seven (7) days prior to the scheduled tour departure time.

Cancellations made prior to seven (7) days before the scheduled tour departure time will result in the forfeiture of the initial deposit.
Modification Policy:
-
Modifications to the number of participants or the selected tour may be made up to forty-eight (48) hours prior to the scheduled tour departure time.

All modification requests must be submitted in writing (via email) to info@korculawinetours.com.

Korcula Wine Tours will make every reasonable effort to accommodate modification requests, but cannot guarantee availability, for our group tours, if the number of participants falls below our minimum of 15 people then the difference will be chargeable to the client.
Tour Cancellation by Korcula Wine Tours:

In the event of a tour cancellation by Korcula Wine Tours, clients will be offered the following options:

A full refund of all payments made.

Rescheduling the tour for an alternative date, subject to availability.
-
Participation in an alternative tour of equivalent value, subject to availability.
-

Korcula wine tours will make every reasonable attempt to contact clients as soon as possible, in the event of a tour cancellation.
7. Dietary Restrictions and Accommodations:
· Notification Requirement: The Company recognizes that participants may have specific dietary restrictions or allergies. To ensure the Company can make reasonable efforts to accommodate these needs, participants must submit a comprehensive list of all dietary restrictions via email to info@korculawinetours.com no less than four (4) calendar days prior to the scheduled tour reservation.
· Communication with Local Establishments: Upon receipt of timely and accurate dietary information, the Company will make reasonable efforts to communicate these requirements to the local restaurants and farms participating in the Food Experiences.
· Reasonable Efforts, Not Guarantees: While the Company will exert reasonable efforts to accommodate dietary restrictions, it cannot guarantee that all requests will be met. The availability of specific ingredients or alternative dishes may be limited at local establishments.
· Winery Limitations: Participants should be aware that Food Experiences conducted at wineries typically involve the consumption of traditional snacks such as cured meats, cheeses, olive oil, and bread. Wineries may have limited capacity to accommodate complex dietary restrictions. Therefore, participants with severe or highly specific dietary needs are advised that accommodation may not be possible at winery stops.
· Late Notification: Dietary restrictions submitted less than four (4) calendar days prior to the scheduled tour reservation will be considered late notifications. The Company makes no guarantees that late notifications can be accommodated. Participants acknowledge that the Company will have no obligation to provide alternative arrangements for late notifications, and no refunds or credits will be issued for any dissatisfaction arising from the inability to accommodate such requests.
· Consumption at Own Risk: Participants with severe allergies or dietary restrictions acknowledge that they consume food and beverages provided during the Food Experiences at their own risk. The Company shall not be held liable for any adverse reactions or health complications arising from the consumption of food or beverages during the tour.
8. Third- Party Operated Tours- Korcula Buggy, Horse Riding And Boat
A. Reseller Status:
Korcula Wine Tours ("KWT") acts as a third-party reseller for certain tours, including but not limited to, Buggy Tours, Horse Riding Tours, and Boat Tours (collectively, "Third-Party Operated Tours"). These tours are operated by independent local companies ("Operators") with whom KWT has established partnerships. KWT does not own, manage, or directly control the operation of these Third-Party Operated Tours.
B. Tour Operation and Execution:
The Operators are solely responsible for the planning, execution, and safety of the Third-Party Operated Tours. KWT's role is limited to facilitating bookings and providing information regarding these tours. Customers who book Third-Party Operated Tours through KWT acknowledge and agree that they are entering into a direct contractual relationship with the respective Operator for the provision of the tour services.
C. Assumption of Risk and Release of Liability:
Customers understand and acknowledge that participation in Third-Party Operated Tours, such as Buggy Tours, Horse Riding Tours, and Boat Tours, involves inherent risks, including but not limited to:

Physical Exertion and Injury: Activities may involve strenuous physical activity, exposure to uneven terrain, and potential for injury.

Equipment Malfunction: Equipment used in these tours may malfunction or fail, leading to accidents or injuries.

Weather Conditions: Tours may be affected by unpredictable weather conditions, which could impact safety and enjoyment.

Animal Behavior: Horse Riding Tours involve interaction with animals, which may behave unpredictably.
-
Water Activities: Boat Tours involve activities on or near water, which carry inherent risks of drowning, injury, or exposure.

Negligence of the Operator: The Operator or its employees may act negligently, leading to accidents or injuries.
D. Full Release and Waiver:
In consideration of KWT facilitating the booking of Third-Party Operated Tours, customers hereby fully and irrevocably release, waive, and discharge KWT, its officers, directors, employees, agents, and affiliates from any and all claims, demands, actions, causes of action, liabilities, damages, costs, and expenses (including attorneys' fees) arising out of or in any way connected with their participation in Third-Party Operated Tours. This release includes, but is not limited to, claims for personal injury, property damage, wrongful death, or any other loss or damage, whether caused by the negligence of KWT, the Operator, or any other party.
E. Customer Responsibility:
Customers are responsible for:

Reviewing and understanding the terms and conditions of the respective Operator.

Adhering to all instructions and safety guidelines provided by the Operator.

Assessing their own physical fitness and ability to participate in the chosen tour.
-
Obtaining appropriate travel insurance that covers participation in adventure activities.
-
Reporting any issues directly to the operator during the tour.
F. Dispute Resolution:
Any disputes or claims arising from or related to Third-Party Operated Tours must be addressed directly with the respective Operator. KWT will not mediate or arbitrate disputes between customers and Operators.
G. Indemnification:
Customers agree to indemnify and hold harmless KWT from any and all claims, liabilities, damages, costs, and expenses (including attorneys' fees) arising out of or in connection with their participation in Third-Party Operated Tours, including but not limited to claims brought by third parties.
H. Operator's Terms and Conditions:
Customers acknowledge that the Operator's terms and conditions may apply to the Third-Party Operated Tours, and it is the customer's responsibility to review and agree to those terms.
9. Force Majeure:
The Company shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, or government regulations.
Governing Law:
These Terms & Conditions shall be governed by and construed in accordance with the laws of Estonia.
